When you write your own will, must take into account the selection of guardians for minor children and the fiduciaries (personal representatives and trustees.)
Selected tutors
Choosing a guardian for minor children is the most difficult decision to write his own will. In my law practice urban goods, that is where we ask clients to start. Tutors are people who have physical custody of their children minors and are responsible for making educational decisions.
In choosing a guardian, to look for people who have a similar parenting philosophy to yours. People are the same or similar decisions their children can have. Nobody will be as good a job as you would raise their children, but we want to be close. You must choose one primary and at least one backup if not two.
Selection of trustees – Personal Representative (s) and administrator (s)
The trust is managing its trustees and funds for children. They must decide whether candidates meet the tutors in three trials party.
– Have you money? (In other words, in its radar and not pay attention to financial matters. They should not be financial experts, but they need to have an awareness of money.)
– Do you spend your own money wisely or frivolity? and
– Do you trust them?
If the answer to all three questions is yes, then it is recommended to appoint the same people as guardians and conservators. This will facilitate the administration. If the answer is no or maybe, we suggest that different individuals may be appointed as trustees and guardians. When writing your own will, if you can answer these difficult questions, the rest is easy.
